Delhi’s Indraprastha Apollo Hospital Faces Supreme Court Scrutiny

The Supreme Court has taken a firm stance against Indraprastha Apollo Hospital in Delhi, warning that if it fails to provide free treatment to poor patients as per its lease agreement, the hospital may be handed over to AIIMS.

A bench of Justices Surya Kant and N Kotiswar Singh expressed concerns over the alleged violation of the lease agreement, under which Apollo Hospital was required to provide free medical services to one-third of its indoor patients and 40% of its outpatient department (OPD) patients.

Hospital Given Prime Land on a Symbolic Lease

The hospital was constructed on 15 acres of land in a prime location in Delhi, leased to the Indraprastha Medical Corporation Limited (IMCL) for just ₹1. The agreement required the hospital to operate on a ‘no profit, no loss’ basis. However, the Supreme Court observed that it had turned into a fully commercial venture where treatment costs were beyond the reach of poor patients.

Court’s Warning: Follow the Agreement or Face Takeover

“If we find out that poor people are not provided free treatment, we will hand over the hospital to AIIMS,” the bench stated, making its position clear.

The court also raised serious concerns about the Delhi government’s involvement, as it holds a 26% stake in the hospital. Justice Surya Kant remarked that if the government was profiting from the hospital rather than ensuring medical care for the underprivileged, it was a “most unfortunate” situation.

Lease Agreement Under Question

The court questioned whether the lease agreement for Apollo Hospital, which was initially set for 30 years and expired in 2023, had been renewed. It asked both the Centre and the Delhi government to clarify what legal steps had been taken regarding the land’s ownership and use.

Hospital Ordered to Submit Patient Records

To assess compliance with the free treatment mandate, the Supreme Court has sought detailed records, including:

  • Total bed strength of the hospital
  • OPD patient data for the past five years
  • A breakdown of how many poor patients received free treatment during this period

The hospital administration has been instructed to cooperate fully with the inspection team and provide all relevant records requested by the monitoring authority.

Historical Legal Battle Over Free Treatment

The Supreme Court was hearing an appeal from IMCL against a 2009 Delhi High Court ruling that found Apollo Hospital guilty of flouting its agreement by failing to provide free treatment. The high court had then ordered the hospital to:

  • Allocate one-third of its total beds (200 beds) to free treatment for poor patients
  • Provide free medical services to 40% of its OPD patients
  • Establish special referral centers in government hospitals for critical patients
  • Admit and treat referred critical patients free of cost, including surgeries, medicines, and other expenses

Additionally, Apollo Hospital was required to prominently display information about free treatment eligibility within its premises and through advertisements.

Consequences of Non-Compliance

The high court had previously imposed a fine of ₹2 lakh on the hospital for raising “frivolous objections” to its free treatment obligations. Now, with the Supreme Court’s intervention, the hospital faces even stricter scrutiny. Failure to comply with the lease conditions could lead to AIIMS taking over the facility.

What’s Next?

The Supreme Court has granted the hospital administration four weeks to submit all necessary documentation. The case will be revisited after the reports are reviewed, determining whether the hospital has adhered to its commitments.

This ruling sends a strong message about accountability in public-private partnerships, especially in critical sectors like healthcare. Will Apollo Hospital comply, or will AIIMS step in to ensure justice for underprivileged patients? The coming weeks will determine the hospital’s fate.
